In a chilling effect of DMCA take down notices, movie review websites have seen a 130% increase in take-down notices in recent months by movie producers.
Hongkong City, Hongkong, June 3, 2010 (PRESSbooth.ORG) -- In a chilling effect of DMCA take down notices, movie review websites have seen a 130% increase in take-down notices in recent months by movie producers. What is interesting is that close to 85% of all notices are on negative comments or reviews.
In one such instance, a Boy’s love movie review website has received an 86% increase in email notices from movie producers trying to get them to remove negative reviews that might affect the commercial success of a film.
The most common notices often cite grounds such as "bashing our actors" and the classic "linking to our websites without authorization".
"The competition for box office dollars has been more aggressive than ever, and flicks from the smaller production houses are constantly pitted against that from the media giants who have more resources to invest in their movies. Furthermore, the popularity of 3D movies brings another dimension to the competition as well," observed Norman, an avid film critic who also runs his own Boy’s love movie review portal. Hence, as of late, we have received an increasing slew of complaints from movie producers using DMCA notices to request for deletion of the “infringing” content which are largely opinion pieces."
What’s interesting to note is that 78% of DMCA notices were filed on movie titles with low consumer ratings. However, while the influx of these attempts to moderate public opinions and boost box office earnings becomes more apparent, most movie review website still comply swiftly to such notices to avoid legal trouble.
"It’s important that movie review websites are allowed to publish honest reviews so that audiences can go to the cinemas to watch a movie they know they will enjoy. Nowadays I often find suspicious raving post on terrible movies by new members with only a single post history. If a movie is bad, word will pass around either way, the internet just amplifies the effect," avid movie-goer Clarence opines.
